Flood Law has filed a civil lawsuit against DMC Sinai-Grace Hospital and its corporate parent, Tenet Healthcare, on behalf of a woman who was sexually assaulted by former nurse Wilfredo Figueroa Berrios while she was receiving treatment. The suit details how Figueroa Berrios—who has been a licensed nurse since 2012 and is already facing multiple criminal charges—violated the trust of patients by repeatedly assaulting Flood’s client during her care.  

DMC and Tenet Healthcare failed in their duty to protect vulnerable individuals by hiring and retaining Berrios. Our firm is pursuing justice for the victim and working to hold these institutions accountable for negligence that allowed this abuse to occur.

DMC and Tenet Healthcare are accused of putting profits over patient safety by: 

● Hiring an employee with a known history of assault, without proper background checks 

● Failing to investigate abuse complaints 

● Inadequate staff training 

Wilfredo Figueroa-Berrios is accused of sexual assault against multiple patients.

In August 2025, she was admitted to DMC while incapacitated and was sexually assaulted multiple times by Figueroa-Berrios. Security video and a police investigation support her claims.
